A provision of the Competition in Contracting Act (CICA) of 1984, authorizes non-competitive contracts to be performed by only one or a limited number of sources via 10 U.S.C. � 2304(c)(1); Federal Acquisition Regulation (FAR) � 6.302-1(a) (2) (iii) (A) and (B). As such, for the purposes described hereunder and in accordance with the Federal Acquisition Regulation (FAR) Subpart 6.302-1, Only one responsible source and no other supplies or services will satisfy agency requirements, coupled with the Authority 10 U.S.C. 2304(c)(1), the Army Corps of Engineers, Chicago District intends to execute, without competition, a bilateral Contract Modification under Contract W912P619P0008 (sole source, Modification P00002). Our incumbent Contractor is BRIMMER INDUSTRIES; the address for this organization is 413 McHenry St, Burlington, WI, 53105-2125, with Company Cage Code No. "72J91." In consideration of the work scoped under the current contract, the incumbent Contractor will be utilizing a skilled workforce and the heavy equipment necessary to complete the work described herein. Because these activities are integral to and are dependent on government furnished items, they must be closely managed and expeditiously implemented to avoid any unnecessary delays or inefficiencies that would directly result in increased cost of performance. Moreover, given the number of contractors already executing work at this location, it is important not to increase the number of contractors to lessen exposure to the corona virus. The resulting modification will implement one new contract line items (CLIN), consisting of Fold-Over Tower Installation for the Chicago Harbor Lock (CHL) Force Protection. The proposed work involves to remove seven (7) existing towers, and install ten (10) new fold-over-tower systems along various structures of the Chicago Harbor Lock (CHL) facility. Using Government Furnished Items, the Contractor will be required to install (7) 30 foot towers, and three (3) 20 foot towers. The work is divided into five components: (1) disassembly and removal of existing towers, (2) transport, assembly and erection of towers at specified locations using the associated hardware; (3) the installation of Aluminum Enclosure boxes to house all the internal electrical equipment; (4) the installation of �� Rigid Conduit from the bottom of the Aluminum Enclosure boxes to an existing Pull Box for running Fiber Optic cables and 120VAC wires; and (5) updating relevant As-Built drawings for the facility with the updated equipment. For the fourth component, the Contractor will NOT pull the fiber optic cables through the �� Rigid Conduit. In addition, the Contractor is responsible for the removal of debris and old towers offsite from the facility. �Fold-Over-Towers and the Aluminum Enclosure boxes will be provided by the US Army Corps of Engineers Chicago District (LRC), as a Government Furnished Equipment.� All work will be accomplished at the Chicago Lock, Chicago District, US Army Corps of Engineers (USACE) located at 108 N Streeter Drive, Chicago, IL, 60611. The primary purpose of this notice is to publicize this contract action prior to contract modification, as mandated in FAR Subpart 5.2 (Synopses of Proposed Contract Actions). The contract type will remain Firm-Fixed Price and the period of performance will not be extended. This notice is not a formal solicitation or request for proposal.
